"Oliver's Law"


Oliver Smith "Oliver's Law" was enacted in 1999 after the death of Oliver Smith, a child who died of massive head injuries while in a licensed family child care home. The child's mother did not know she could look at the licensing reports on the home and therefore was unaware that several complaints had been reported against the provider.

The State law requires every child care resource & referral agency and alternative payment program to inform anyone who requests a child care referral of their right to check the records of child care providers. They have a right to see a copy of licensing reports pertaining to the facility and the right to receive a more complete file regarding the facility from the State Department of Social Services Community Care Licensing Division. A parent has a right to access public information in the child care provider files.
